Terms of Service
The agreement governing your use of Funded with Flow, including accounts, paid plans, evaluations, trading rules and your responsibilities.
1. Acceptance of Terms
These Terms of Service (the Terms) form a binding agreement between you and Funded with Flow L.L.C. (Funded with Flow, the Platform, we, us, or our) governing your access to and use of fundedwithflow.com and all related products, software, and services (collectively, the Services).
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Acceptable Use Policy, Refund Policy, and other policies referenced herein. If you do not agree, you must not use the Services.
If you use the Services on behalf of an entity, you represent that you are authorized to bind that entity, and you refers to that entity.
2. Eligibility
You may use the Services only if you are an individual who is at least the age of majority in your jurisdiction and are not barred from using the Services under any applicable law.
You represent and warrant that the information you provide is accurate and complete, that you are not located in or a resident of any jurisdiction in which use of the Services is prohibited, and that you are not on any government list of prohibited or restricted parties.
We may refuse, suspend, or terminate access to anyone at our discretion, including where eligibility cannot be verified.
3. Account Registration and Security
To use most features you must register an account using email or Google sign-in (OAuth). You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You agree to:
- provide accurate registration information and keep it current;
- keep your login credentials and any API or MCP tokens secret;
- notify us promptly at [email protected] of any unauthorized access or suspected compromise.
We authenticate sessions using session cookies. We are not liable for any loss arising from your failure to safeguard your account.
4. Platform Access and the Simulated Environment
The Services provide a simulated, evaluation-based trading practice environment. All trading on the Platform is simulated. We are not a broker-dealer, investment adviser, financial adviser, exchange, custodian, clearing firm, or bank, and we do not execute orders on live exchanges or markets on your behalf.
We simulate trading in futures (such as ES, NQ, MES, MNQ, and GC), equities, and options (single-leg and multi-leg). Simulated capital, balances, profits, and losses are not real and do not represent actual money, securities, or positions held by or on your behalf.
Access to the Services is provided on an as-available basis and may be modified, suspended, or discontinued at any time.
5. Paid Plans and One-Time Purchases
We offer free paper practice accounts as well as paid evaluation challenges. Pricing varies by plan and is presented at the point of purchase. Most purchases are one-time evaluation or challenge fees.
All payments are processed by our third-party payment processor, Stripe. We do not store full payment card data. By purchasing, you authorize the applicable charge and agree to Stripe's terms in addition to these Terms.
Fees are governed by our Refund Policy. Initiating a chargeback or payment dispute will automatically revoke your access to associated accounts and may result in termination, without limiting our other remedies.
6. Paper Trading, Evaluations, and Funded Status
Accounts progress through phases: paper (free practice with simulated capital), evaluation (paid challenge), and funded (simulated trading with Platform-defined profit-sharing eligibility). Account statuses include active, warning, passed, failed, and disabled.
A funded account remains a simulated environment. You do not own, control, or have any claim to Platform capital, and funded status confers only eligibility to request payouts under our rules, subject to verification and review.
Meeting an evaluation requires hitting the applicable profit target, satisfying the consistency rule, completing any minimum trading days, and not breaching any account rule. We do not guarantee that any account will pass, advance, or become funded.
7. Trading Rules (Vary by Plan)
Each plan is governed by rules that are configurable by us and vary by plan. Depending on the plan, these may include:
- a profit target;
- a daily loss limit;
- a maximum drawdown (trailing, static, or end-of-day);
- maximum contracts and position-sizing limits;
- a minimum number of trading days;
- a consistency rule (a minimum number of qualifying trading days and no single day exceeding approximately 40% of total profit); and
- for no-drawdown plans, an exposure cap in place of a trailing drawdown.
Breaching the daily loss limit or maximum drawdown ends the account (it is failed or liquidated). The specific rules applicable to your account are shown in the Platform and control. You are responsible for understanding the rules of your plan.
8. Prohibited Conduct
You agree not to misuse the Services. Prohibited conduct is described in detail in our Acceptable Use Policy and includes, without limitation, fraud, market manipulation, exploiting bugs or errors, unauthorized access, abusive automation, scraping, reselling or redistributing protected data, circumventing payment, rules, limits, or security controls, and any unlawful activity.
Violations may result in immediate suspension or termination, forfeiture of evaluation progress and payout eligibility, and reversal of any benefits obtained through the violation.
9. Market-Data Restrictions
Real-time market data is provided through an aggregator sourced from a third-party market-data provider. Market data is provided for your in-platform use only.
Market data may be delayed, inaccurate, incomplete, interrupted, or unavailable, and we make no warranty as to its timeliness, accuracy, or availability. You must not redistribute, resell, scrape, store, or otherwise reuse market data outside the Services. Additional restrictions imposed by the data provider may apply, and you agree to comply with them.
10. No Financial or Investment Advice
The Services are provided for education, practice, and evaluation only. Nothing on the Platform, including any content, data, tools, or AI output, constitutes financial, investment, tax, legal, or other professional advice, or a recommendation, solicitation, or offer to buy or sell any security or instrument.
You are solely responsible for evaluating any information and for your own decisions. You should consult a qualified, licensed professional before making any real-world financial decision.
11. No Guarantee of Profits, Funded Approval, or Payouts
We do not guarantee any outcome. We do not guarantee that you will earn profits, pass an evaluation, become funded, qualify for a payout, or receive any particular amount. Simulated past performance is not indicative of any future result, real or simulated.
Payouts are discretionary and subject to eligibility checks, identity and KYC verification, rule-compliance review, and fraud review, and may be delayed or denied. Trading, including simulated trading, involves substantial risk.
12. User Responsibility and Risk Acknowledgement
You acknowledge and accept that trading involves substantial risk and that you use the Services at your own risk. You are solely responsible for your trading decisions, your configuration and use of any automation, your compliance with applicable law, and any taxes arising from any payout you may receive.
You acknowledge that the environment is simulated, that results may differ materially from live markets, and that we are not responsible for any decision you make based on the Services.
13. AI and Automation (MCP and API)
We offer an AI support assistant that provides informational responses only and cannot execute trades. AI output may be inaccurate or incomplete; do not rely on it as advice, and verify anything important.
We also offer a Model Context Protocol (MCP) server that lets you connect AI agents to your account using per-key permissioned tokens. Tokens are read-only by default; trade permission is opt-in and additionally gated. Tokens are stored hashed, are rate-limited and revocable, and access is logged.
You are fully responsible for any agent or automation you authorize and for all activity performed under your tokens. You must keep tokens secret and revoke any token that may be compromised.
14. Account Suspension and Termination
We may suspend, disable, or terminate your account or access, in whole or in part, at any time, with or without notice, including for actual or suspected violations of these Terms or our policies, fraud or abuse, chargebacks or disputes, legal or security reasons, or where required by a service provider.
You may stop using the Services at any time. Upon termination, your right to use the Services ends. Provisions that by their nature should survive termination will survive, including disclaimers, limitations of liability, indemnification, and dispute provisions. Termination does not entitle you to any refund except as stated in the Refund Policy.
15. Disclaimers and Limitation of Liability
The Services are provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant the accuracy or availability of market data, AI output, or any execution or simulation quality.
To the maximum extent permitted by law, in no event will Funded with Flow or its affiliates, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, data, goodwill, or simulated gains, arising out of or relating to the Services.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services will not exceed the amount you paid to us for the Services in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100), whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
16. Indemnification
You agree to indemnify, defend, and hold harmless Funded with Flow and its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Services, your violation of these Terms or applicable law, your content or automation, or your infringement of any third-party right.
17. Dispute Handling and Governing Law
Informal resolution first. Before initiating any formal proceeding, you agree to contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
These Terms are governed by the laws of the United States and the state in which Funded with Flow L.L.C. is organized, without regard to conflict-of-laws rules. The parties consent to resolve disputes in accordance with applicable law, and any final dispute-resolution mechanism (including any arbitration or venue provisions) will be confirmed in the executed version of these Terms.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the date below and may provide additional notice. Changes are effective when posted unless stated otherwise. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
